Terms of Service

These terms are the agreement between you and spdev labs Ltd, the company behind WhereToGo. They are written to be read, so please do. By creating an account or using the app you accept them.

1. Who we are

WhereToGo is an app for sharing places you like and seeing where the people you follow are going. It is operated by spdev labs Ltd, a company registered in England and Wales under company number 17474506, with its registered office at 12 Constance Street, London E16 2DQ, United Kingdom. “We”, “us” and “spdev labs” mean spdev labs Ltd; “you” means you.

2. Who may use it

You must be at least 18 years old. WhereToGo is made for adults: it shows where people are and lets strangers talk to each other, and we do not offer it to anyone younger. If you use WhereToGo on behalf of an organisation, you confirm you are allowed to accept these terms for it.

3. Your account

• Give accurate information when you sign up, and keep your account details current.
• You are responsible for what happens through your account. Keep your sign-in secure and tell us promptly if you think someone else has it.
• Do not impersonate someone else or pick a handle in order to pass yourself off as them.
• You may delete your account at any time. See deleting your account.

4. Your content, and the licence you give us

You remain the author of the photos, captions, comments and messages you post, and you confirm that you have the right to post them.

By posting content you grant spdev labs Ltd an exclusive, worldwide, perpetual, irrevocable, royalty-free and transferable licence, with the right to sublicense, to host, store, reproduce, adapt (including resizing, cropping and changing format), publish, display, distribute and make derivative works from that content — in WhereToGo, and in any other medium or service now known or later developed, including to promote WhereToGo.

Exclusive means that no other service, publication or business may be given the right to use content you post here; that right is ours alone. It does not restrict you personally: you may keep, show and share your own photos and words outside WhereToGo however you like. The exclusivity is against other businesses, not against the person who took the picture.

Two limits on how we use it. Inside the app, your content is shown only to the people your own privacy settings allow. Outside the app, we will use only content you have set to be visible to everyone, and we will name you as its author where the format allows. So far as the law permits, you agree not to assert moral rights in a way that would prevent us exercising this licence, for example over routine cropping and resizing.

When you delete content or your account, we remove it from the app and delete the stored files as the Privacy Policy describes. The licence then continues only for copies made in the ordinary running of the service — backups, which expire on their normal schedule — and for promotional material already created with your everyone-visible content before you deleted it.

We will not sell your content to data brokers, and we will not place it in third-party advertising.

5. Rules

Do not use WhereToGo to:

• post anything unlawful, hateful, harassing, or that attacks people for who they are;
• post sexual content involving minors, or any content that sexualises a child — this is reported to the authorities without exception;
• threaten, bully, stalk or intimidate anyone;
• post someone else's private information, including their home or workplace, without their consent;
• post content you do not have the right to post, including other people's photos;
• use anyone's presence or location on WhereToGo to follow, monitor or turn up on them against their wishes;
• impersonate anyone, or misrepresent where a place is;
• send spam, run bots, scrape the service, or try to break, overload or get around the security of any part of it;
• reverse engineer the app except where the law expressly permits it.

6. Other people's privacy

WhereToGo shows where people choose to be seen. Treat that as something entrusted to you: what someone shares inside the app is for the app. Do not republish another person's location, presence or private posts elsewhere, and do not build any record of someone's movements. Doing so is a breach of these terms and, in many places, of the law.

7. Content posted by other people

Posts, comments and messages are written by users, not by us. We do not check them before they appear and we do not endorse them. Places, opening times, crowd levels and photos may be wrong, out of date or missing — use your judgement, especially when deciding to travel somewhere.

You can report content in the app. We look at reports and may remove content or restrict an account when these terms are broken.

8. Where place information comes from

Information about places comes from Foursquare's open places data; maps are built from OpenStreetMap data, © OpenStreetMap contributors; and some photographs of places are borrowed from Wikimedia Commons, via Wikipedia, under their Creative Commons licences and credited to their photographers beside the image. Those sources have their own terms, and the attribution shown in the app must not be removed.

9. What belongs to us, and what may not be copied

WhereToGo — the app, its software and design, the WhereToGo name and mark, and the selection, arrangement and compilation of places, photographs, posts and messages taken as a whole — belongs to spdev labs Ltd or its licensors. The collection is protected as a database. Content posted by users is licensed exclusively to us under section 4.

You may look at content in the app as the app presents it. You may not copy, download (other than through features the app itself provides), scrape, crawl, harvest, index, store, republish, redistribute, sell, or display outside WhereToGo any content, data or image from the service, whether by hand or by automated means, without our written permission. This applies to everyone, whether or not they hold an account, and to any service that reproduces content from WhereToGo. The third-party sources named above stay under their own licences, which permit no more than they say.

10. Ending things

You can stop using WhereToGo and delete your account whenever you want.

We may suspend or close an account that breaks these terms, that we are legally required to act on, or that puts other people at risk. Where it is reasonable to do so we will tell you why and give you a chance to respond. If we close your account by mistake, write to us and we will put it right.

11. The service may change

WhereToGo is under active development. Features may be added, changed or withdrawn. We will not remove something you depend on without notice inside the app where we reasonably can.

12. No warranty

WhereToGo is provided “as is”. We do our best to keep it accurate and available, but we do not promise that it will be uninterrupted, error-free, or that the information in it is correct or complete. To the fullest extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.

13. Limits on our liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost data, or anything arising from your reliance on place information or from your dealings with other users or with the places themselves. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited — and if you are a consumer, your statutory rights are unaffected.

14. Changes to these terms

If we change these terms we will update the date above and tell you in the app before material changes take effect. Continuing to use WhereToGo afterwards means you accept the new version; if you do not, you can delete your account.

15. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory laws of your own country, or of the right to bring proceedings there.
